Procedure is regulated

Besides, the procedure of contracting a marriage and documentation of marriage before the courts has also been regulated. It is done under the Personal Status federal decree law.

Additionally, the process of divorce has also been revised. Under the new law, the divorce can be initiated unilaterally and even jointly. Why dubai law firm and dubai lawyer, it is a long debate. But we can at least mention that both are good for having any query related to acquiring the assistance or just grabbing the details.

Process of settling

Law manages the process of settling the financial claims arising at the time of divorce. It also organized the arrangement for joint child custody after the divorce settlement was finalized. Federal decree law also organizes the adequate processes for inheritance. The introduction of will, testaments, and proofs of paternity are also managed systematically as per the law. New law aims to provide a bigger say to the woman in the process of court. During the court proceedings, the women in UAE will be given equal and more rights than before in the court procedures.

Inheritance case, the women enjoy the leverage of equal rights in filing for inheritance which was not possible in the past. Alongside this, more power is granted to the women to have legal battles in cases like divorce and joint child custody. Till the children reach the age of 18, they will be under joint custody of mother and father. After that, the children will have the full right to choose between their parents.

This mostly happens in the case of divorce which is followed by a child custody case if children are involved. Under the new law, child custody can be shared by both father and mother. Moreover, anyone can submit a request to exclude the other based on solid grounds.  In this case, both the parents have to file for the requests to the court to look into the legal matter.

According to the law and the given scenario, the court will decide what is best for the child’s welfare. In such cases, children’s well-being and betterment are given the utmost importance. Under the new law, the marriages for non-Muslim expatriates will be acknowledged following civil marriage contracts. In this, the set of conditions must be met before acknowledgment.

What new law says?

According to the new law, in a divorce case, one of the spouses should inform the court of their intentions to end the marriage. The termination of the marriage needs no justification and reasoning like before.

Besides, it also refrains from the divorce process that involves blaming the other spouse. The divorce case can easily be filed without blaming or arming the other spouse.

Major features

Major feature of the law is that the new law adopts the Gregorian calendar rather than Hijri. It also dismisses the need to submit the reasoning for the divorce to process it.

Another Eminent feature

Another eminent feature of the new law is that the alimony is calculated based on several different factors. It includes the duration of the marriage, the financial standing of both spouses and the extent of responsibility over the husband for the divorce.

The laws are established to provide them convenience and thus, give greater autonomy to their decision-making. In case of divorce, non-Muslim women are given greater liberty and independence. Before the law, the women could not unilaterally call for a divorce proceeding to begin. Now, the woman in the UAE is given the authority to initiate a divorce process according to her free will.
